Couple convicted of murder conspiracy granted bail

Two lovers convicted of plotting the murders of their spouses have been released pending an appeal.

Curtis Vey and Angela Nicholson were released last week on different conditions including that they not contact each other.

They had been sentenced to three years in prison after Vey’s wife recorded him and Nicholson plotting the murders.

The appeal hearings are expected to be heard in 2017, although the exact dates have not yet been confirmed.

The appeals are based on the argument the presiding judge failed to properly explain to jurors what is necessary to be convicted of conspiracy. Specifically there was failure to prove beyond a reasonable doubt Nicholson and Vey would have followed through with the plan.

The defense lawyers have also clamed the trial judge erred in further instruction about whether an aquittal or conviction was applicable to both parties or just one.
